Statuam and Client Code of Conduct and Ethics

We, at STATUAM, don’t do an ad hoc session every now and then because it lacks focus andenergy and commitment to your goal.  Once you have submitted your pre coaching form and arranged a coaching session we will do our professional best to help you achieve your goal.

The most important part of the coaching process is your accountability for achieving the goals you agree to achieve.  Proper investigation into your goal sometimes means it changes in scope, scale and attractiveness and can even evolve into something new.

When you have a coaching session these are the things you must bring to it:

Presence of mind for your goal.

Your diary

A pen

A quiet environment.

It’s important to be comfortable so ensure if you need a drink you have one ready.

If circumstances change your goal, you must tell the coach so they can help you adjust it.

Your Conduct

Be on time for your session.  The coach will not go over time, even if you are late and even if it is on your premises.

Fully commit to the time allotted and the process.

Arrange for no interruption.

Do not leave your mobile devices on, even on silent.  They will distract you.  Turn them all off.

If in a Skype coaching session, close down your other applications too.

Your coach will only speak with you when you have a pre booked session.

Your coach is there to coach, not do psychoanalysis, or offer suggestions.

They are not there to hear improper suggestions and will not be subject to any form of aggression, language included.

If you naturally use swear words, as long as the coach understands this is how you tend to communicate, things will go smoothly.

Our Code of Conduct

 We will always behave decently and respectfully and ensure we check our notes about your goal before your session.

We are not trained to push you into anything.  There is no coercion to agree goals.

It is fine if you find you would like to change your goal, we can still go through the process with you, but we will challenge you to ensure you stick to your original goal as closely as possible if you still want to achieve the same end result.

We are paid to ask questions and will always do this respectfully, but may challenge you for the best outcome.

If you feel uncomfortable about a question we can look at it together and try to help you resolve it.

You pay us to keep you on track and we will do this to the best of our ability.

Employers/Employees:

Employers do not need to know what their employees say in coaching sessions unless they are paying for the coaching sessions and criminal activity has been identified.

Please sign, date and send the Notification and AGREEMENT for reasons of legal DISCLOSURE document below, once you have read it fully, agreed to it’s terms and been accepted for coaching.  Receipt of the completed form does not automatically mean acceptance for coaching.  Thank you.

Statuams General Code of Conduct:

Statuams statement of Ethics is closely aligned to international coaching ethics standards.

Relationship of Ethics and Australian Law

The Law of Australia, will take precedent over Statuam its owner, employees and subcontractors will, at a minimum, strive to adhere to the Code of Ethics.

A coach should not engage in any illegal activities, including, but not limited to, copyright, intellectual property rights, or patent violations.

Professional Relationship

Our coaching organisation provides services only in the context of Statuam professional standards.Trust and responsibility are the heart of the coaching profession, so it is expected that Statuam coaches will always act with integrity towards their clients, their peers, and themselves.

Competence In Coaching

Statuam will not knowingly lay claim to a level of competence not possessed, and will at all times exercise competence at least to the level we have claimed.

Statuam coaches will provide services only within the boundaries of our competence, based on education, training, or appropriate professional experience. Statuam coaches will only accept coaching work as they believe they are competent to perform.

Keeping up

Statuam coaches will always attempt to maintain a reasonable level of awareness of current best business practices and professional information in their coaching activity, and undertake ongoing efforts to maintain competence in the skills they use, as far as is practical for them and try to keep themselves informed of new technologies, practices, legal requirements and standards, relevant to the coaching profession.

Understanding Statuam coaching services.

When coaches provide coaching services, (inclusive of any pre coaching information), to an individual, a group, or an organization, they use language that is reasonably understandable to all users of those services.

If the law precludes Statuam from providing such information to particular individuals or groups, we inform those individuals or groups at the outset of the coaching service.

Respecting Clients

Respect for the individual is a cornerstone of the Statuam coaching relationship.  As Statuam coaches we respect the rights of others to hold values, attitudes, and opinions that differ from our own.

Unfair Discrimination

Statuam coaches do not engage in unfair discrimination against our clients, employees or subcontractors, on any basis, whatsoever.

Harassment

Statuam does not knowingly engage in behavior that is harassing or demeaning to persons with whom they interact in their work. Sexual harassment is sexual solicitation, physical advances, or verbal or nonverbal conduct that is sexual in nature. Statuam coaches ensure that our behavior is at all times appropriate and can in no way be described as harassment in any form.

Personal Issues and Conflicts

A Statuam coach recognise, that like any individual, they may experience personal problems which may exert an adverse effect upon the coach client relationship. Accordingly coaches inform clients of any such problems, and together appropriate action is taken, such as rearranging sessions or referring the client to another coaching service.

It is Statuams opinion that all coaches have an obligation to be alert to signs of, and to obtain assistance for, personal problems at an early stage, in order to prevent impairment of their coaching performance. When coaches become aware of personal problems that may interfere with their performing coaching-related duties adequately, they take appropriate measures, such as professional consultation or assistance, and determine whether they should limit, suspend, or terminate their current coaching activity.

Progression

Statuam takes reasonable steps to, when possible to ensure that the client progresses, and in cases where there is no progress Statuam will strive to minimize any negative effects to the client, while ensuring the client has understood their personal responsibility for reaching initial,  intermediate and end stage goals, agreed by the client from the initial coaching session and throughout the process.

Abuse of a Statuam coaches’ influence

A Statuams coaches’ professional judgments and actions may affect the lives of others, so they should ensure they are alert to and guard against personal, financial, social, organizational, or political factors, which may lead to misuse of their influence.

Misuse of Statuam Coaching Work

Statuam coaches do not participate in activities in which it appears likely that their skills or assessments will be misused by others for any reason. If Statuam learns of misuse or misrepresentation of our work, we will take reasonable steps to correct or minimise the misuse or misrepresentation.

Conflict of Interest

Whenever feasible, Statuam coaches refrain from taking on professional obligations when preexisting relationships would create a risk of conflict of interest.  If, due to unforeseen factors, a potential conflict of interest relationship arises, the coach attempts to resolve it with due regard for the best interests of the affected person and compliance with the Statuam Ethics Code, even if this means advising a client to be coached by another firm.

Barter

A Statuam coach will not barter services.

Exploitative Relationships

Statuam does not:

Exploit persons over whom they may have a management role.

Engage in sexual relationships with clients or personnel over whom the coach has evaluative or direct authority, except when in a legally recognized partnership of coaches.

Referrals

When indicated and if professionally appropriate, Statuam coaches may cooperate with other professionals in order to serve their client effectively and appropriately.

Third-party Requests for Services

When a Statuam coach agrees to provide services to an individual or entity at the request of a third party, the coach clarifies to the extent feasible, at the outset of the service:

  • the nature of the relationship with each party
  • the role of the Statuam coach (for example, organisational consultant)
  • the uses of the services provided and the information obtained.
  • the reality that there may be limits to confidentiality.

 

If there is a foreseeable risk of a Statuam coach being called upon to perform conflicting roles because of the involvement of a third party, the coach clarifies the nature and direction of his or her responsibilities, keeps all parties appropriately informed as matters develop, and resolves the situation in accordance with Statuams Ethics Code.

Delegation and supervision of  staff

Statuam coaches may delegate to their employees or subcontractors (still working confidentially), and assistants only those responsibilities that such persons can reasonably be expected to perform competently, on the basis of their education, training, or experience, either independently or with the level of supervision being provided.

Employed Statuam coaches will provide proper training and supervision to employees and ensure their subcontractors have signed a declaration of suitability and confidentiality and take reasonable steps to see that such persons perform services responsibly, competently, and ethically, indemnifying Mrs. Mandy Worrall personally and as owner of Statuam and employee of Statuam against any claim, prosecution, penalty or litigation brought about by their dealings.  Any person subcontracting to Statuam directly or indirectly through a member of the Statuam team shall indemnify Mrs. Mandy Worrall personally and as owner against any claim, prosecution, penalty or litigation brought about by their dealings.

 Records and Information Management

Statuam will create, maintain, disseminate, store, retain, and dispose of records and data relating to their practice, and other work in accordance with the Australian law, and in a manner that permits compliance with the requirements of this Statuam Ethics Statuam Code

Our coaches are recommended to appropriately document their work in order to facilitate provision of services later by them or by other professionals, to ensure accountability, and to meet other legal requirements of Australia.

Statuam Fees and Financial Arrangements

The coach and the client, or other appropriate recipient of coaching services reach an agreement specifying our fees and the billing arrangements, prior to coaching sessions.

Statuam does not exploit recipients of services or payers with respect to fees, nor do coaches misrepresent their fees.

If there is an issue with payment of fees for coaching services which can be anticipated because of limitations in financing, this is discussed with the client, or other appropriate recipient of services as early as is feasible.

If the client, or other recipient of services does not pay for services as agreed (cancelled cheque), and if Statuam wishes to use collection agencies or legal measures to collect the fees, Statuam first informs the person that such measures will be taken and provides that person or organisation an opportunity make prompt payment.  Until arrangements have been made for payment, Statuam reserves the right to suspend/cancel all sessions indefinitely.

Accuracy in reports to paying clients or paying sponsors

In their reports to payers for services, Statuam accurately and clearly state the nature of the service provided, the fees and/or all other charges.

Referral Fees

When Statuam pays, receives payment from, or divides fees with another professional other than in an employer – employee relationship, the payment to each is based on the services (referral, consultative, administrative or other) provided, and is agreed in writing prior to engagement.

Statuam Advertising/Public Statements

Advertising / Public Statements refer to any written documents or verbal statements that a Statuam coach makes publicly available (brochures, articles, speeches, or professional resumes) relating to coaching.

Statements by Others

Statuam understands that others may engage in making public statements for them, whether specifically asked to do so or not. Statuam will try to ensure that any such public statements on its behalf are true and not misleading.

Avoidance of False Statements

Statuam agrees not to make any public statements that are false, under any circumstance, especially statements including a coach training or experience and the fees charged.

Coaching Relationship /Structuring the Relationship

Statuam coaches will explain their fee structure prior to the first paid coaching session with a client and discuss important topics as early as possible in the coaching sessions. Confidentiality is always mentioned in documentation and verbally before any coaching commences. We agree to refer clients to other professionals when relevant, including to a counselor, therapist, or psychiatrist as soon as possible if they see or hear a problem that may necessitate mental health treatment, or is outside their scope to deal with in a session.  Statuam makes an effort to answer clients’ questions and address their concerns about coaching as promptly and honestly as possible. When available, a coach will provide written information to address specific concerns about coaching if anything is unclear or mentioned in the information sent to all clients.

Safety and Well-Being

Statuam must make an appropriate referral to a Mental Health Professional or Emergency Service Professional at an early point of recognising situations in which clients may put their own safety or well-being at risk, or the safety or well-being of others at risk, and in severe situations the Coach must contact a Mental Health Crisis Service or Emergency Service on behalf of the client.

We are not trained to attempt to diagnose, quantify or assess any mental health issue or specific problem where clients may put themselves or others at risk, but must act solely out of their personal experience, as Statuam coaches licensed by Statuam to make such diagnoses or assessments.

Statuam will notify the appropriate authorities when a client discloses that they are harming or endangering another individual or group. Statuam must also attempt to notify the person or group who is being harmed or endangered. Statuam coaches do not need to discern if a mental health problem is present or in fact if the current or imminent harm is in fact illegal.

Providing Statuam coaching services to those in the care of mental health professionals:

It is the individual coach who must decide whether or not to enter into a coaching relationship with a client who is currently undergoing psychotherapy or other mental health treatment. The clients’ welfare is paramount.

Sexual Intimacies With Clients

Statuam coaches agree not to be sexually involved with current clients who they are not cohabiting with or married to legally.

Interruption of Service

Statuam coaches will make reasonable efforts to make other arrangements for any interruption of coaching services. For longer-term interruptions a few weeks, the coach is will refer clients to other coaches/coaching organisations until they are able to resume the coaching contract.

Terminating the Statuam Coaching Relationship

Statuam coaches agree to terminate a coaching relationship when it becomes clear that the client is no longer gaining benefit (or is being harmed) by the existing coaching relationship. In terminating the relationship, coaches will suggest alternatives or provide referrals to coaches or other professional services when appropriate.

Statuam Privacy and Confidentiality

These Standards are applicable to the professional activities of any and all Statuam coaches.

Discussing Confidentiality and its Limitations

Statuam respects the client’s right to privacy. They do not solicit private information from the client unless it is essential in the provision of services, or the implementation of research. The standards of confidentiality apply once the coaching agreement has been signed.

The discussion of confidentiality occurs at the beginning of the professional relationship, unless it is contraindicated or infeasible, and from then on as necessary coaches discuss the nature of confidentiality and its limitations with clients and other interested parties.

Coaches examine situations in which confidential information may be requested or disclosed.  All information obtained in the course of the professional service is confidential, unless there is a compelling professional reason for its disclosure. Coaches will disclose confidential information without a specific release if it is necessary to prevent foreseeable imminent harm to the client or another.  In all circumstances, coaches will be judicious in the amount of information that is disclosed.

Maintaining Confidentiality

Statuam coaches will exercise prudence in the protection of the confidentiality rights of those with whom they work or consult. Coaches acknowledge that professional relationships, institutional regulations, and/or the law may establish confidentiality.
Statuam coaches will not discuss confidential information in any setting unless privacy can be assured.

Statuam will discuss confidential information only for appropriate professional, consultative, or scientific purposes and only with persons clearly concerned with such matters:

In their dealings with the public and media (including professional presentations, and writing) coaches will be careful to guard the confidentiality of their clients. We will disguise confidential information so that clients are not individually identifiable

Coaches will only disclose confidential information if the client or legally authorised individual has given express written consent, or in a consultative capacity.  Statuam coaches do not share confidential information that could lead to the identification of a client with whom they have a confidential relationship.  Statuam coaches may only share this information if they have obtained the prior consent of the client, or if the disclosure cannot be avoided. Information is shared only to the extent necessary to achieve the purposes of the coaching consultation.

Statuam  takes logical precautions to protect client confidentiality: in the event of the coach’s cessation of practice, incapacitation, or death.

In the case of deceased clients in accordance with the Statuam Ethics Code.

Records and Information Management:

Statuam maintains confidentiality when creating, storing, accessing, transferring, and disposing of records under their authority in accordance with the Stauam Ethics Code and laws of Australia, taking precautions to ensure and maintain the confidentiality of information communicated through the use of telephone, voice mail, computers, email, instant messaging, facsimile machines, and other information technology sources.

Statuam takes practical and lawful steps to assure that records remain available in order to serve the best interests of clients.

Disclosures

Unless prohibited by law, Statuam will only disclose confidential information if:

The client, or person legally authorised to consent on behalf of the client, has given express written consent.

Statuam  may disclose confidential information without the consent of the client only as mandated or permitted by law.  When possible, Statuam will inform clients about the disclosure of confidential information and possible ramifications before the disclosure is made and will only disclose confidential information to third party payers with the appropriate written consent.

Statuam must disclose certain confidential information as required by law or if the confidential information may put the client or others at risk of harm or compromise their well-being.

Providing Coaching training

At this time Statuam is not involved with training individuals to become coaches.  When the situation changes, Ethics in line with this activity will be freely available.

Statuam is owned by Mrs. Mandy Worrall. It began in 2013.  Mention is made in this document of other Statuam coaches because it is her intention to expand the personnel of the coaching organisation when it is practical to do so.
